Terms of service

These terms cover coaching sessions sold through https://ishanyash.com by Ishan Yash, sole trader, trading as Upstream ("I", "me"). By booking a session you agree to them.

What the service is

Career coaching for data engineers: help with CVs, LinkedIn profiles, interview preparation, job search strategy and understanding the UK data engineering market. Sessions are delivered online at the time you book, and written deliverables are sent by email within the time stated on the session's description.

What the service is not

Immigration advice. I am not a regulated immigration adviser and I do not give advice about visas, immigration routes, sponsorship eligibility or settlement, even informally. Those questions must go to a solicitor or an adviser registered with the Immigration Advice Authority. If a session drifts into that territory I will stop it there.

A guarantee. Nothing I provide guarantees interviews, offers or a job. The outcome depends on the market and on you.

Legal, financial or employment-law advice. For contracts, disputes or pay claims, talk to a professional in that field.

Booking and payment

The free fit call is booked through Cal.com. Paid sessions are agreed on that call; I confirm the session and its price in writing, and payment is made by card link (Stripe) or bank transfer before the session takes place. Prices are in pounds sterling and include VAT where applicable. The student price on the CV review needs a current university email address.

Changing or cancelling a session

You can move or cancel any session up to 24 hours before it starts, at no charge, using the link in your confirmation email. Sessions cancelled with less than 24 hours' notice, or missed, are charged in full, because the time was held for you. If I have to cancel, you get the choice of a new time or a full refund.

Your 14-day right to cancel

Because you buy online, you have the right under the Consumer Contracts Regulations 2013 to cancel within 14 days of booking without giving a reason, by sending a message through the contact form. If you ask me to start work within those 14 days (which booking a session inside that window does), you agree that you will pay for whatever has been delivered by the time you cancel, and that once a session or package is complete the right to cancel ends. Refunds are paid within 14 days of your cancellation, to the method you paid with.

If a session isn't right

If you are unhappy with a single session, tell me within 24 hours and I will refund it in full. For the four-week sprint, refunds for unused weeks are pro rata.

Your part

You agree to turn up on time, to be honest about your experience (I will never help you put something untrue on a CV), and to do the work between sessions. Mock interviews are recorded only with your written agreement, and recordings are deleted 90 days after our last session.

My liability

I will deliver the service with reasonable care and skill. Beyond the price you paid for the session, I am not liable for losses that were not a foreseeable result of my breaking these terms. Nothing here limits liability that cannot be limited by law.

Everything else

These terms are governed by the law of England and Wales. If any part of them is found unenforceable, the rest still applies. You can reach me through the contact form about anything in them.
